Will 14th Amendment throw Electoral Vote to Kerry?

Not likely, but possible.

"According to the 14th Amendment (Section 2) of the U.S. Constitution, "...[W]hen the right to vote... is denied... or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens... in such State.""

There is clear evidence of a pattern of official minority voter intimidation in Ohio and Florida, as well as targeted efforts to prevent or illegally disqualify minority registration, and an indisputable pattern of inequitable distribution of voting machines in black urban and strongly Democratic voting precincts.

According to the Green Party, under Section 2 that means Ohio and Florida could see their Electoral votes reduced in proportion to their black - or Democratic - voters.
